I was behind a CRX queuing in an intersection to make a left turn. Light went yellow, CRX waited for a few oncoming cars to clear and went through. I started to go through, and another car came around a lane and through the red... did my best to dodge, was hit on the passenger side (thank god I was by myself!) spun ~180 degrees clockwise (was turning into Westbound, am now facing Eastbound) and stopped once my rear hit a transport truck.
The Golf that hit me had the hood compressed by about 1-1.5'.. transmission fluid was spilling out and the motor was smoking.
Transport that I spun into just has cosmetic damage and was able to drive away once the Police were all done helping us out.
Thankfully the amazing couple in the CRX stopped and hung around to act as witnesses (and another car stopped too just to make sure everyone was OK). E is at the collision centre for the night, waiting for them to open and give me the verdict.....
I'm a little sore. The police on site were terrific, down to earth and handled things in no time. I'm disappointed in myself for not being able to dodge the Golf. But very happy everyone's OK! Money's cheap compared to life and love :)
Considering the damage to the other car (no pictures, sorry- but the entire front end was done), I'm proud of the E. She was hit right on the double doors.. with a car going atleast 40-70km/h. She kept me safe and that's all I need right now :)

I agree, the monetary loss will never outweigh the health of anyone.

shrugs* 06-02-2008, 07:10 PM I'd like to get another AWD E but 5-speed.. but I guess we'll have to see how much insurance is willing to fork out. My gut feeling is leading me towards something cheaper.. a Fit or Civic. Unfortunately I'm a full-time student only working part-time, so leveraging the situation for a timely car upgrade isn't really an option.
I cleaned her on Saturday... somehow it makes me feel better to see she's still pretty, albeit a little deformed.
Oii, it chokes me up to think I won't ever get to roll with my big blue toaster anymore.

I'm not really surprised the E survived so well, and the other vehicle came out so badly (It's the way it is, bad things are returned 3 times upon those who commit evil) And E's are very able to withstand some pretty hard hits!

Get ready for a fight with the insurance...
No fault means just that. They will asses responsibility based upon their own criteria, if they can. This means that you will have to fight with them NOT to. If they determine that you are in any way responsible for the accident, your rates are going up...
Was the other driver charged? Should have been, since you said they ran the red. You can also state that you were already in the intersection, making your turn, when you tried to avoid the accident.
What was the speed limit? If the other vehicle was speeding when it hit you, on a red, then the shouldn't asses you with any responsibility...(but they'll try, anyway...)
If the other driver is charged, and you have witness', then make sure the blame goes to them, 100%!

Witness reports (from the car ahead of me,and the transport I hit) both work in my favour.. so hopefully things work out. Trying very hard to stay positive :)

It's good to hear nobody got hurt seriously however if you are feeling pain you should go see a doctor A.S.A.P. By the way I am NOT a lawyer, I've heard too many horror stories about people having problems down the road and insurance won't pay.

We have No Fault insurance in Ontario, so you have to deal with your insurance company only. But that's part of the problem. As you said there are different rules for commercial and regular drivers, but they assess blame the way they want to (what will come out to their advantage) and what they can get away with. Forewarned is fore armed.
I've seen instances where another driver is solely to blame, under the Highway Traffic Act, and charged accordingly, but the victim driver is still assessed a portion of responsibility for not doing everything they can to avoid the accident by their own insurance company...
And they won't tell you this. You have to be pretty specific in your questions to your insurance, and make sure you set the groundwork from the get go, that you will not accept any portion of responsibility!
As a driver Manager, Commercial Driving Instructor, and Defensive Driving Instructor, I can tell you that we train drivers that there is no such thing as a 'no fault' accident - each driver is to blame, because if you had been paying attention, you would not have been there...:rolleyes:. BUT these rules are supposed to apply only to professional commercial drivers, because this is how they are trained. The average driver has no such training, and therefore cannot be expected to follow these rules. Insurance companies 'forget' this, and follow these rules whenever they can...

From what I'm reading, and from seeing the damage to your E, the Police are correct in not charging you. The main point of impact is behind the passenger door, indicating that you were substantially thru your turn when the other vehicle hit you. Besides, as you said, you have witness, who can definitely prove what colour the light was when you had entered the intersection, and started your turn.
You can be charged if they suspect you entered the intersection to begin your turn after the light turned yellow. Damage to the front end, or front quarter usually indicates that you should have waited for the approaching vehicle to clear the intersection first.

Thanks for everyone's input, without it I'm sure I would've gone insane with worry.
Now I just need to hear from the collision centre whether ol' Blue is going to be receiving CPR or not.
And then I can finally get out of this damn rental! It feels as if it would be a fun car if was more 'connected' with the driver. All of the inputs feel dull and unresponsive.. steering is too light, brakes feel like cotton on porcelain, and the transmission randomly shifts. But my biggest quirk is the utter lack of engine braking. Although I'm sure this is due to whatever measures are set in place to maintain fuel economy, letting the car coast and naturally slow down is impossible when it's only dropping 5km/h per 100m (not so much in the Intermediate mode, but the shift points are way out of wack on my 4000km rental). Out of the domestic compacts, I have to say the Focus is still my favourite.

She's a total loss. $13 000 in damages, I'm receiving a little more than that from insurance.
Hopefully this thread will be standing proof of the E's safety and maybe lend some insight on the cost of damages.
I'm not going to lie, seeing the E in this condition (and DIRTY) broke my heart.

...if it were not for an accident that i was in two years ago i would not be riding in my E....the dealership came and got me a couple of days outa of the hospital and hooked me up with my present ride and i bought it used...
...eerily simular situation as yours and got jerked around at the beginning by the the dude at fault's insurance company who finally after four weeks of me chasing them down to respond to my complaints blithly told me to "SUE THEM"!
so, i got a lawyer and a year later i am laughing all the way to the bank in my blue E!
Glad to hear that your okay but i feel your pain, especially in my left knee on a really knarly damp cold day!

Funny story, it's a full moon and I'm studying for a midterm. Full moons drive me wild, ala teenwolf/leisure suit larry.
Around midnight I call up an old fling from my first year of college (she lives about 120km away).
1:45AM, we meet up and she drops her car off at a parking lot. We go for a spin in the country.
2:00AM, I wish we had met up closer to my comfy home.
2:15AM, I think "Civics are small. Cloth interior isn't as 'wipe-clean friendly' as the E."
2:30AM, enter forest.
......
5:00AM, we take a nap in a carpool parking lot (for 15 minutes), before I drop her off at her car.
6:30AM, I arrive on campus and cram for the 8:00AM midterm.
7:30AM, I enter the scheduled room with mud on my knees, elbows and with random forest bits stuck all over me.
7:31AM-7:59AM, I pass out.
8:00AM, write midterm.
Passed the midterm. After nearly 6 years of post-secondary education, you'd think I would've known better. I blame it all on the full moon. And the previously mentioned *****.
btw, Civic is now on 00 SiR rims and Falken 512 rubbers.

...and just like the E, is obsessively cleaned.
So far my thoughts of the Civic vs Element as the daily...
1. FWD open diff sucks in the rain. Or gravel. Or mud.. or anything that isn't clean, level, smooth pavement.
2. D17 is a terrific motor, just like the D16. It's also unfortunately neutered, I still miss the K24's powerband.
3. Real car outsides (paint all around) is hell to keep clean (it's been a while since I've owned a black car, I must've forgotten how much of my life it steals). Dust plagues my life.
4. Real car insides (carpet and other fuzzy things) is hell to keep clean. Beach = ohgodsand. I don't like people, they have all sorts of crap stuck to them. I can see it crawl all over them.
5. The Element Shuffle (working out how a rear passenger gets out w/ the Es that have door mounted seatbelts) still beats The Suckinyergut and Squeeze Coupe Workout.
6. Owning the Civic confirms how well the E handled (for it's size). Although I remember my EM1 Civic being a lot tighter than the half-double wishbone/half-macpherson strut ugly stepchild EM2.
7. 6L/100km beats 10L/100km. I'm saving a few hundred a month. This is my favourite part.
8. Chicks, in fact, do dig the Element. I can't even count how many times I've gotten "awww.. I miss the Sex Box.."
9. Although it hurts, my winter/tow car search has now evolved to a Pilot or MDX... unless anyone's hauled 2 x sportbikes with an Element and wants to share how well it worked?
