I haven't seen this posted anywhere yet...my brother-in-law said he heard a story on the radio this weekend that Hummer (or AMC or whoever) is suing Honda because the Element looks too much like their models. Any truth to this? I wouldn't think they'd have a leg to stand on, but who knows? Or maybe he just misheard a joke?

GM Sues Avanti Over XUV Design
Studebaker XUV Said To Be H2 Copy

POSTED: 11:11 a.m. EST February 28, 2003

DETROIT -- General Motors is suing Avanti Motor Corporation over the design of the boxy Studebaker XUV.

Hummer H2

GM claims it looks too much like the Hummer H2 (pictured, left).

A federal judge in Detroit will hear GM's request for a court order for Avanti to stop producing the sport utility vehicle.

Avanti Studebaker XUV

The trademark hearing is set for June. The Studebaker XUV (pictured, right) debuted at the Chicago Auto Show a couple of weeks ago.

Avanti said it's nothing like the Hummer, because it has sliding rear side doors and a sliding rear roof.

Thanks...well, I agree with GMC, because that looks exactly like a Hummer to me.

Well, speaking at the resident legal counsel, they may have a claim, but I can't tell from the pic in the story.

They woujld really have to make the Avanti look like a knock off for it to be a viable suit. The old saying from the Apple/Microsoft time, the look and feel is the test.

When I was at the auto show, I first saw that thing from the back. And I first thought it was an H2. The back to me looked very close to identical to the H2. I concluded that in order for them to be making it, GM must own them too. Guess I was wrong...

Well, it "kinda" looks like a Hummer, if you have a Twilight Zone kind of mind and squint your eyes.
