Rather than just compound the frustration felt by the many people with the cracked windshield problem, I decided to contact the channel 2 news segment "Shame On You" via e-mail. I don't know if it will help, but it certainly won't hurt. I also filed my NHTSA complaint. Here is the e-mail message in full:

Honda created a new car called the Element. It's a wonderful car except that there are cases of the windshield cracking, apparently from stress. A service bulletin was issued on the problem, but some dealerships have been honoring the windshield fix which consists of warranty replacement, while other dealers are just blowing the consumers away. There appears to be no set standard, and people with the cracked windshield problem have had to travel from one dealer to another until they encounter a service department to warranty their Element. Many cases have been documented at www.elementownersclub.com in the message board under problems and issues. I, like many other Element owners scan the boards looking for tips and other info. I sympathized with the people with the problem, figuring that it couldn't possibly happen to me. It happened and I got the same brush off as many other people. I am at step 3 of the process. I went to my salesperson who took me to the service manager who pointed out a little pit (pin size) claiming that it was an impact point. I asked to see the regional service rep (who won't be available for seveal weeks)and had my phone number taken so I can be informed when he resurfaces. By the way, my VIN comes under the numbers put out on the TSB, but the service manager never gave me a chance to offer it, giving instead the standard answer. If nothing else your intervention would compel Honda to address the issue in a reasonable manner. Thank you....

Well after a long wait there is no magic bullet forthcoming. However, I have been successful in bringing attention to my particular problem. I will continue in the problems & issues area under windshields.
